1. Acceptance of Terms
By visiting our store, browsing our website, or making a purchase — whether in person or online — you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before placing an order or completing a transaction. If you do not agree with any part of these Terms, please do not use our services.
These Terms apply to all customers of Zermeño’s Western Wear, located in Texas, operating both a physical retail store and an online shop.
2. Products and Availability
We reserve the right to modify, discontinue, or limit the availability of any product at any time without prior notice. All product descriptions, images, and pricing are provided in good faith and are subject to change.
Product colors may vary slightly from what is displayed on your screen due to differences in monitor settings and photography lighting. We make every effort to represent our merchandise as accurately as possible.
In the event that an item you ordered is out of stock or unavailable after your purchase, we will contact you promptly to offer an alternative solution or a store credit.
3. Pricing and Payment
All prices are listed in U.S. Dollars (USD) and are subject to applicable Texas state sales tax. Prices are subject to change without notice.
We accept credit and debit card payments. By providing your payment information, you represent that you are authorized to use the payment method and that the information provided is accurate.
We reserve the right to cancel or refuse any order if we suspect fraud, an unauthorized transaction, or any other irregularity. In such cases, we will notify you and, if a charge was made, issue a reversal.
4. Orders and Order Confirmation
Placing an order constitutes an offer to purchase. Your order is not confirmed until you receive an order confirmation from us. We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of pricing errors, product unavailability, or suspected fraud.
It is your responsibility to provide accurate shipping and contact information at the time of purchase. Zermeño’s Western Wear is not responsible for delays or failed deliveries resulting from incorrect or incomplete information provided by the customer.
5. Shipping and Delivery
We ship orders within the United States. Shipping times are estimates and are not guaranteed. Zermeño’s Western Wear is not responsible for delays caused by shipping carriers, weather conditions, or other circumstances beyond our control.
Risk of loss and title for items purchased pass to you upon delivery to the carrier. If your package is lost or damaged in transit, please contact the carrier directly. We will assist where possible but cannot be held liable for carrier-related issues.
In-store pickup is available for online orders. You will be notified when your order is ready.
6. No Refund Policy
ALL SALES ARE FINAL. Zermeño’s Western Wear does not offer refunds under any circumstances.
We take great care to ensure the quality and accuracy of every order. However, once a purchase is completed — whether in store or online — it is considered final and no monetary refund will be issued.
We encourage all customers to carefully review product details, sizing guides, and descriptions before completing a purchase. If you have any questions about a product prior to buying, please contact us at contact@zermenoswstern.com and we will be happy to assist.
6.1 Exceptions — Defective or Incorrect Items
The only exception to our no-refund policy applies to items that are:
- Received in a defective condition (manufacturing defect, damaged upon arrival), or
- Incorrect items shipped due to an error on our part.
In these cases only, we will offer a store credit or an exchange for the correct item, at our discretion. To be eligible, you must contact us within 5 business days of receiving your order, and items must be unworn, unwashed, and in their original condition with all tags attached.
We reserve the right to request photographic evidence of the defect or error before authorizing any exchange or store credit.
6.2 No Exceptions for Change of Mind
We do not accept returns or issue refunds for:
- Change of mind or buyer’s remorse
- Incorrect size selection by the customer
- Items that have been worn, washed, or altered
- Sale or discounted items
- In-store purchases
7. Exchanges and Store Credit
Exchanges are not guaranteed and are offered solely at the discretion of Zermeño’s Western Wear, limited to the defective/incorrect item scenarios described in Section 6.1. Store credit, when issued, has no cash value and may not be exchanged for money. Store credit does not expire.
8. Intellectual Property
All content on our website and promotional materials — including but not limited to text, images, logos, and graphics — is the property of Zermeño’s Western Wear and may not be reproduced, distributed, or used without our express written permission.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Zermeño’s Western Wear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services, including but not limited to loss of profits, data, or goodwill.
Our total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount paid by you for the specific product or service giving rise to the claim.
10. Disclaimer of Warranties
Our products are provided “as is.” We make no warranties, express or implied, beyond what is described in the product listing at the time of purchase. We do not warrant that products will meet every individual customer’s expectations for fit, style, or personal preference — these are subjective factors and do not constitute defects.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Texas.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to our website or display in our physical store. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
